LIMITED WARRANTY INFORMATION

	Warranty

1. Limited Warranty and Disclaimer. ESC Products warrants to you, the original purchaser, that for one (1) year after your purchase of it, the Product will be free from defects in materials and workmanship. This warranty will not apply to any Product that (a) has not been installed, operated or maintained in accordance with applicable instructions, (b) has been repaired or altered by unauthorized personnel, or (c) has been misused, abused, damaged or subjected to operation for which it was not intended. Your exclusive remedy, and ESC Products' sole liability, for any breach of the foregoing warranty will be repair or replacement of the defective Product, or refund of your purchase price, at ESC Products' sole option. For the foregoing warranty to be effective, you must return any defective Product along with proof of original purchase within the warranty period, postage prepaid, to ESC Products at the address set forth below. Repaired or replaced Product will be warranted for the longer of (i) the remainder of the original warranty period, and (ii) ninety (90) days from the date of return shipment to you. THE FOREGOING WARRANTIES ARE EXCLUSIVE, AND ESC PRODUCTS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING BY COURSE OF DEALING OR TRADE USAGE.

2. Limitation of Liability. IN NO EVENT WILL ESC PRODUCTS BE LIABLE FOR (A) ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR OTHER INDIRECT DAMAGES, OR (B) ANY DAMAGES IN EXCESS OF THE PRICE YOU PAID FOR THE PRODUCT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT ESC PRODUCTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3. Miscellaneous. The warranties, disclaimer and other terms set forth herein represent the entire agreement and understanding between you and ESC Products as to the subject matter hereof and may not be amended except in a writing signed by you and ESC Products. Any dispute between the parties as to the subject matter hereof will be governed by laws of the State of Washington without reference to its conflict of law provisions to the contrary. You irrevocably submit to jurisdiction in the state and federal courts located in Clallam County, Washington, U.S.A. with regard to any such dispute.
